PARTICIPATION AGREEMENT:

TERMS & CONDITIONS, POLICIES, AND WAIVERS

This PARTICIPATION AGREEMENT (this "Agreement") is entered into between Dietz

Ventures, LLC, a Wisconsin limited liability company doing business as VolleyWisconsin

("VolleyWisconsin," "we," "us," or "our"), and the undersigned participant or, if the participant is

under 18 years of age, the participant's parent or legal guardian (together, "you"). By registering for,

booking, paying for, or participating in any VolleyWisconsin lesson, clinic, camp, or training session

(each, a "Session"), you agree to the terms below.

1. Programs, Booking, and Payment. VolleyWisconsin provides volleyball training to athletes in

individual, small-group, and group formats at partner facilities throughout Wisconsin. Sessions must

be booked and paid for in advance through our booking platform or as otherwise directed by

VolleyWisconsin. Your booking is not confirmed until payment is received.

Session times, locations, and coach assignments are subject to availability. VolleyWisconsin may

substitute a coach of comparable qualification when necessary. Posted prices are subject to change,

but a confirmed, paid booking will be honored at the price paid.

2. Cancellation Policy. At VolleyWisconsin, we reserve court time and schedule coaches specifically

for each athlete. Because each of our facility partners has different reservation requirements,

cancellation policies vary by location. We appreciate your understanding and cooperation.

Cedarburg.

• Cancellations made 48 hours or more before the scheduled session are eligible for a full refund

or account credit.

• Cancellations made less than 48 hours before the scheduled session are non-refundable.

• No-shows are non-refundable.

Glendale. See above.

Greendale. See above.

Franklin. Policy coming soon. As we finalize our partnership in Franklin, the cancellation policy

for this location will be communicated prior to booking.

Nashotah. Because this facility requires VolleyWisconsin to reserve and pay for court time 7 days

in advance, the following policy applies:

• Cancellations made 7 days or more before the scheduled session are eligible for a full refund

or account credit.

• Cancellations made within 7 days of the scheduled session are subject to a $50 cancellation

fee, with the remaining balance refunded or issued as account credit.

• Cancellations made within 48 hours of the scheduled session are non-refundable.

• No-shows are non-refundable.

Sun Prairie. Because this facility requires VolleyWisconsin to reserve and pay for court time 7 days

in advance, the following policy applies:

• Cancellations made 7 days or more before the scheduled session are eligible for a full refund

or account credit.

• Cancellations made within 7 days of the scheduled session are subject to a $50 cancellation

fee, with the remaining balance refunded or issued as account credit.

• Cancellations made within 48 hours of the scheduled session are non-refundable.

• No-shows are non-refundable.

General Cancellation Terms

• Cancellation requests must be made through your booking confirmation or by contacting

VolleyWisconsin directly. The date and time we receive your request determines which

cancellation window applies.

• If VolleyWisconsin must cancel a session due to coach illness, facility closure, or other

unforeseen circumstances, you will receive the option to reschedule, receive an account credit, or

receive a full refund. No cancellation fee applies to cancellations initiated by VolleyWisconsin.

• Account credits do not expire but are non-transferable and have no cash value except as described

above.

By booking a lesson, clinic, camp, or training session with VolleyWisconsin, you acknowledge and

agree to this cancellation policy.

3. Code of Conduct. All participants, including athletes, parents, guardians, and spectators, are

expected to abide by the following Code of Conduct at all VolleyWisconsin Sessions and facilities:

• Treat all athletes, coaches, staff, facility personnel, and spectators with respect and dignity at all

times.

• Follow all rules of the host facility, including parking, spectator, and equipment policies.

• Direct concerns or complaints to VolleyWisconsin leadership by email following a 24-hour

cooling-off period. Coaches will not engage in disputes during or immediately after a Session.

• Abusive language, harassment, threats, or physical aggression of any kind will not be tolerated.

VolleyWisconsin may, in its discretion, remove any participant or spectator from a Session, or suspend

or terminate future participation, for conduct that violates this Code of Conduct or endangers the safety

or experience of others. Fees for Sessions ended or forfeited due to a conduct violation are non-

refundable.

4. Concussion and Head Injury Policy. VolleyWisconsin follows Wisconsin's youth concussion law,

Wis. Stat. § 118.293, and the concussion guidance published by the U.S. Centers for Disease Control

and Prevention (CDC HEADS UP program, available at cdc.gov/headsup).

• Before an athlete's first Session, the athlete and (if the athlete is a minor) a parent or guardian

must review the concussion and head injury information sheet provided by VolleyWisconsin and

sign this acknowledgment.

• Any athlete who exhibits signs, symptoms, or behavior consistent with a concussion or head

injury, or who is suspected of having sustained one, will be removed from activity immediately.

• An athlete removed under this policy may not return to VolleyWisconsin activity until the athlete

is evaluated by a qualified health care provider and provides VolleyWisconsin with written

clearance to return.

By signing below, you acknowledge that you have received and reviewed concussion and head injury

information consistent with Wis. Stat. § 118.293 and agree to this policy.

5. Assumption of Risk, Release of Liability, and Indemnification. PLEASE READ

CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS. You are free to ask

questions about this section, request changes before signing, or decline to participate. Contact

VolleyWisconsin before signing if you have questions.

Assumption of Inherent Risks. Volleyball training is a physical activity that involves inherent risks

that cannot be eliminated even with proper equipment, coaching, and personal discipline. These risks

include, without limitation: sprains, strains, fractures, and other musculoskeletal injuries; contact with

balls, nets, poles, floors, walls, or other participants; falls and collisions; concussion and other head

injuries; heat-related illness; and, in rare cases, catastrophic injury, permanent disability, paralysis, or

death. Risks also arise from the condition of the facilities where Sessions are held, which are owned

and operated by third parties.

I understand these risks, and I knowingly and voluntarily assume all inherent risks of participation,

both known and unknown. I agree that the athlete will participate within the athlete's own abilities,

will use required equipment, and will follow coach and facility instructions. If I observe an unusual or

significant hazard, I will remove myself (or my athlete) from participation and immediately report the

hazard to the nearest VolleyWisconsin coach or staff member.

Release and Waiver. In consideration of being permitted to participate in VolleyWisconsin Sessions,

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, release,

waive, and discharge Dietz Ventures, LLC d/b/a VolleyWisconsin, its members, officers, employees,

coaches, independent contractors, and agents, and the owners and lessors of the facilities where

Sessions are held (collectively, the "Released Parties"), from any and all claims, demands, or causes

of action for injury, disability, death, or loss or damage to person or property arising out of or relating

to participation in VolleyWisconsin Sessions, including claims based on the ordinary negligence of

the Released Parties, to the fullest extent permitted by Wisconsin law.

This release does not apply to claims arising from reckless, intentional, or criminal conduct, or to any

claim that cannot lawfully be waived. If any part of this release is held unenforceable, the remainder

shall continue in effect, and the release shall be enforced to the maximum extent Wisconsin law allows.

Participation by Minors; Parent Agreement. If the athlete is under 18, the undersigned parent or

legal guardian signs this Agreement on the athlete's behalf, represents that they have legal authority to

do so, and agrees to all terms of this Agreement both individually and on the athlete's behalf. The

parent or guardian personally assumes the inherent risks described above on their own behalf, releases

the Released Parties from the parent's or guardian's own claims arising from the athlete's participation,

and agrees to indemnify and hold harmless the Released Parties from any claim brought by or on

behalf of the minor athlete, to the fullest extent permitted by Wisconsin law.

Medical Authorization. I authorize VolleyWisconsin coaches and staff to obtain or provide

emergency medical care for the athlete if a parent or guardian cannot be reached, and I accept financial

responsibility for any such care. I represent that the athlete is physically able to participate and has no

condition that would make participation unsafe, or that any such condition has been disclosed to

VolleyWisconsin in writing.

6. Communicable Disease Acknowledgment. An inherent risk of exposure to communicable

diseases, including COVID-19, influenza, and other illnesses, exists in any public place where people

are present. By attending any VolleyWisconsin Session, I voluntarily assume all risks related to

exposure to communicable disease, on my own behalf and on behalf of the athlete.

7. Photography and Media Consent (Optional). VolleyWisconsin occasionally photographs and

records Sessions for training review, advertising, social media, and other promotional purposes. This

consent is optional and is not a condition of participation. If consent is given below, I authorize

VolleyWisconsin to use the athlete's photograph, video, likeness, name, and comments for the

purposes described above, without compensation, and I waive any right to inspect or approve the

finished materials. I may revoke this consent as to future use at any time by written notice to

VolleyWisconsin; revocation does not apply to materials already published or in production.

8. General Terms

• Governing law and venue. This Agreement is governed by Wisconsin law. Any dispute arising

under this Agreement shall be brought in the state courts of Wisconsin.

• Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining

provisions remain in full force, and any invalid provision will be enforced to the maximum extent

permitted by law.

• Entire agreement; amendment. This Agreement, together with the booking confirmation for each

Session, is the entire agreement between the parties regarding participation and supersedes any

prior understanding. VolleyWisconsin may update its Terms & Conditions and policies

prospectively; updated terms apply to Sessions booked after the update is posted.

• Electronic signature. This Agreement may be signed electronically, including by checkbox

acknowledgment during online booking, and an electronic signature has the same effect as an

original.

Acknowledgment and Signature. I have read this entire Agreement, I understand it, I have had the

opportunity to ask questions about it, and I sign it freely and voluntarily. Please initial each item below
